I am an LVN in CA and I'm 22. At my job for 1 yr. My supervisor wrote in my eval. that I am very young.?

Is this legal? I've read the Equal Opportunity Act and it states that only persons over the age of 40 and covered under this act. Is there any hope for people under 40?
